Subject: All India Seniority Lists of Inspector Posts (IP) for the Years 2017, 2018 & 2019-reg.

Madam Sir,
I am directed to refer to the aforementioned subject and to inform that following an extensive review of the guidelines issued by the Department of Personnel & Training (DoPT) OM No. 20011/2/2019-Estt.(D) dated 13.08.2021, which was issued in pursuance of the Hon’ble Supreme Court of India’s order in the case of K. Meghchandra Singh & Ors v/s Nigam Siro & Ors, the instructions pertaining to the determination of seniority between direct recruits (DR) and departmental promotees (DP), as well as their inter-se seniority, have been modified.

2, These modifications are based on criteria mentioned in para-7 of the aforementioned OM. With reference to the provisions of OM dated 13.08.2021, it is clarified by DoPT that: –

(i) The provisions of para 7 (iv) of DoPT OM dated 13.08.2021 shall not apply, where all the appointments under either of the methods of recruitment prescribed in the Service/ Recruitment Rules viz, either promotion or direct recruitment, have been made on or after 19.11.2019.

(ii) Where all the persons recommended for appointment either on promotion basis or on direct recruitment basis, joined the post on or after 19.11.2019, their inter-se seniority would be governed by para 7 (v) of OM dated 13.08.2021 i.e. w.r.t. the year of their actual joining/appointment to the post.


3. The recruitment process for direct recruits and promotees of the year 2017 & 2018 were though initiated before 19.11.2019, but all appointments, subsequent of the initiation of recruitment process, were made after 19.11.2019, thereby their inter-se seniority would be governed by para 7(v) of DoPT OM dated 13.08.2021. Thus, direct recruits and promotees of the year 2017 & 2018 would get their seniority in the year they actually joined/appointed in the IP cadre. Similarly, all appointments, subsequent of the initiation of recruitment process of the year 2019. were made after 19.11.2019, therefore they would get seniority in the year they actually joined/appointed in the [P cadre in accordance with DoPT OM dated 13.08.2021.

4. Therelore, it has been decided by the competent authority that All India Seniority List of IP for the year 2017 issued vide letter no. X-07/17/2022-SPN-H dated 14.03.2024, 16.02.2023 and 12.09.2022 and All India Seniority List of IP for the year 2018 issued vide letter no. X-07/18/2022-SPN-I dated 20.07.2023, 20.02.2023 and 12.02.2022. are withdrawn ab initio.

5. Further, since IP appointed/promoted on the basis of recruitment year 2017, 2018 & 2019 have joined in the year 2020 onwards, therefore, All India Seniority Lists of Inspector Posts (IP) for the years 2017, 2018 & 2019 will not be prepared. IP appointed/promoted on the basis of
aforementioned recruitment year would get seniority in the year they actually joined/appointed in the IP cadre in accordance with DoPT OM dated 13.08.2021.

6. This issues with the approval of competent authority in consultation with the DOPT ID notes No. 20034/3/2024-Pers. Policy (D-Seniority) dated 20.11.2024 and 15.01.2025.
