GRANT OF NOTIONAL INCREMENT TO THE EMPLOYEES

3798. SHRI NAGENDRA RAY:
Will the PRIME MINISTER be pleased to state:

(a)whether Government has issued orders for grant of notional increment on 1st July/1st January to the employees who retired from Central Government service on 30th June/31stDecember respectively for the purpose of calculating their pensionary benefits;

(b) if so, the date from which this order has been applicable and implemented; and

(c) whether the implementing of the order is applicable to the employees who have retired prior to 2023?

ANSWER

MINISTER OF STATE IN THE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS AND MINISTER OF STATE IN THE PRIME MINISTER’S OFFICE (DR. JITENDRA SINGH)

(a): Yes. Instructions in this regard were issued vide D/o Personnel & Training’s O.M. No. 19/116/2024-Pers.Pol. (Pay)(pt) dated 14.10.2024 in pursuance of the Interim Order dated 06.09.2024 passed by the Hon’ble Supreme Court in M.A. Dy. No. 2400/2024, and after due consultation with D/o Legal Affairs and D/o Expenditure.

(b) and (c): It has been provided in para 6 of D/o Personnel & Training’s O.M. No.19/116/2024-Pers. Pol. (Pay)(pt) dated 14.10.2024 that the judgment dated 11.04.2023 will be given effect to in case of third parties from the date of the judgment, that is, the pension by taking into account one increment will be payable on and after 01.05.2023. Enhanced pension for the period prior to 30.04.2023 will not be paid. In case any retired employee has filed any application or writ petition and a beneficial order has been passed, the enhanced pension by including one increment will be payable from the month in which the application for intervention/impleadment was filed.

क्या प्रधान मंत्री यह बताने की कृपा करेंगे कि:

(क) क्या सरकार ने 30 जून/31 दिसंबर को केंद्र सरकार की सेवा से सेवानिवृत्त हुए कर्मचारियों को उनके पेंशन लाभ की गणना के उद्देश्य से 1 जुलाई/1 जनवरी को सांकेतिक वेतन वृद्धि प्रदान करने के आदेश जारी किए हैं;

(ख) यदि हां, तो यह आदेश किस तारीख से अनुप्रयोज्य एवं कार्यान्वित हुआ है; और

(ग) क्या इस आदेश का कार्यान्वयन वर्ष 2023 से पहले सेवानिवृत्त हुए कर्मचारियों पर अनुप्रयोज्य है?

(क) : जी हां। इस संबंध में माननीय उच्चतम न्यायालय द्वारा एम.ए. डायरी सं. 2400/2024 में दिनांक 06.09.2024 को पारित अंतरिम आदेश के अनुसरण में तथा विधि कार्य विभाग और व्यय विभाग के साथ उचित परामर्श के उपरांत, कार्मिक और प्रशिक्षण विभाग के दिनांक 14.10.2024 के कार्यालय ज्ञापन सं.19/116/2024-कार्मिक नीति (वेतन) (पीटी) के माध्यम से अनुदेश जारी किए गए थे।

(ख) और (ग) : कार्मिक एवं प्रशिक्षण विभाग के दिनांक 14.10.2024 के कार्यालय ज्ञापन संख्या 19/116/2024-कार्मिक नीति (वेतन)(पीटी) के पैरा 6 में यह प्रावधान किया गया है कि दिनांक 11.04.2023 का निर्णय तृतीय पक्षों के मामले में निर्णय की तिथि से प्रभावी होगा, अर्थात, एक वेतन वृद्धि को ध्यान में रखते हुए पेंशन, दिनांक 01.05.2023 को और उसके बाद देय होगी। दिनांक 30.04.2023 से पहले की अवधि के लिए बढ़ी हुई पेंशन का भुगतान नहीं किया जाएगा। यदि किसी सेवानिवृत्त कर्मचारी ने कोई आवेदन या रिट याचिका दायर की है और हितकारी आदेश पारित किया गया है, तो एक वेतन वृद्धि सहित बढ़ी हुई पेंशन उस महीने से देय होगी जिसमें हस्तक्षेप+अभियोजन (इम्प्लीडमेंट) के लिए आवेदन दायर किया गया था।
