112. Whether the review DPC can change the grading of an officer without any reasons?

No. The review DPC is required to consider the cases again only with reference to technical or factual mistakes that took place earlier. It should neither change the grading of an officer without any valid reason nor change the zone of consideration nor take into account any subsequent vacancies.

113. Whether recommendations of the DPC is mandatory for implementation or the appointing authority can reject the same?
The recommendations of DPC are advisory in nature and should be duly approved by the appointing authority. If the appointing Authority does not accept the recommendation, he should indicate the reasons to DPC for reconsideration.
If the DPC reiterated its earlier recommendations with justification, the Appointing Authority may either accept or refer the matter to the higher authority whose decision will be final.

114. What is the date from which promotions are to be treated as regular?
The date of promotion will be date of actual promotion, or the date of DPC meeting in case of persons already holding the higher post on adhoc basis.


115. If a person refused his promotion, when his case will be considered again for promotion.
The official refusing promotion will not be offered any promotion for a period of one year from the date of such refusal or till a vacancy arises, whichever is later.
