Revision/Change of option in Pay Fixation
• Revised Option: Government servants may revise their pay fixation option under FR 22(I)(a)(1) within a month of unforeseen developments or rule changes.
• Approval: The revised option needs approval from the concerned Ministry/Department and the Department of Personnel & Training.
• Finality: Once a revised option is accepted, it becomes final.
Pursuant to any unforeseen developments or change of rules, a Government Servant may give a revised option for pay fixation under FR 22(I)(a)(1) within one month from the date of orders of such unforeseen developments or change of rules. Acceptance of such revised option may thereafter be examined and decided on merits by the Ministry/Department concerned with the approval of Department of Personnel & Training. In case, it is decided to allow fresh option to the Government Servant concerned, the option once exercised shall be treated as final.

ReplyDeleteIf i interpret this OM in correct, officials who got promotion/MACP between 02.07.2015 and 31.12.2015 are also eligible to opt for fixation of pay on promotion from DNI i.e. 01.07.2016 under FR 22(i)(a)(1) in the revised pay structure after switching to 7cpc on 01.01.2016, if it Is beneficial for them.

It is came to know that The pay of many employees who got promotion/MACP between 01.01.2016 and 25.07.2016, has not been correctly fixed under the provisions of FR22(i)(a)(1). Since they had opted for fixation of pay on promotion/MACP from DNI before notification of CCS(RP) Rules-2016 (i.e. in the 6th Pay Commission regime).
OR some employees were not allowed to re-exercise the option of pay fixation under FR 22(i)(a)(1) from DNI under Para 2 of OM No. 16/8/2000-Estt.(Pay-I) dated 25.02.2003 as many Government departments did not know how to do it.
To make the above matter clear some examples follow.
1) Shri X who got promotion from GP 2800+PPB 11920 (PB1) to GP 4200 (PB2) on dated 01.10.2015 (Any date between 02.07.2015 and 31.12.2015). He opted for fixation of pay on promotion from DNI i.e. 01.07.2016 (in the 6th Pay Commission regime). On implementation of 7CPC he opted for switching over to 7th CPC from 01.01.2016 under rule 5 of CCS (RP) Rules- 2016.
2) Shri X who got promotion from GP 2800+PPB 11920 (PB1) to GP 4200 (PB2) on dated 01.01.2016. He opted for fixation of pay on promotion from DNI i.e. 01.07.2016 (in the 6th Pay Commission regime). On implementation of 7CPC he opted for switching over to 7th CPC from Date of Promotion i.e. 01.01.2016 under rule 5 of CCS (RP) Rules- 2016.
3) Shri X who got promotion from GP 2800+PPB 11920 (PB1) to GP 4200 (PB2) on dated 01.05.2016. He opted for fixation of pay on promotion from DNI i.e. 01.07.2016 (in the 6th Pay Commission regime). On implementation of 7CPC he opted for switching over to 7th CPC from Date of Promotion i.e. 01.05.2016 under rule 5 of CCS (RP) Rules- 2016.
4) Shri X who got promotion from GP 2800+PPB 11920 (PB1) to GP 4200 (PB2) on dated 01.07.2016. He opted for fixation of pay on promotion from DOP i.e. 01.07.2016 (in the 6th Pay Commission regime). On implementation of 7CPC he opted for switching over to 7th CPC from Date of Promotion i.e. 01.07.2016 under rule 5 of CCS (RP) Rules- 2016.
5) Shri X who got promotion from GP 2800+PPB 11920 (PB1) to GP 4200 (PB2) on dated 20.07.2016. He opted for fixation of pay on promotion from DNI i.e. 01.07.2017 (in the 6th Pay Commission regime). On implementation of 7CPC he opted for switching over to 7th CPC from Date of Promotion i.e. 20.07.2016 under rule 5 of CCS (RP) Rules- 2016.
No one knows how these cases will be resolved ? Because Government ministries have not suggested a solution till date.
Therefore, it is necessary that these be resolved by the Ministry.
