21. Whether the annual increment due during the period of maternity leave will be drawn from the date of joining the duties after leave or from the date it is due?
When an employee is proceeding on leave, she is entitled to draw leave salary equivalent to the pay drawn before proceeding on such leave. Accordingly, the annual increment falling during the period maternity leave will be drawn only from the date on which one joins her duties..
22. What are the allowances exempted from attachment of salary?
(i) All kinds of travelling allowances.
(ii) All kinds of conveyance allowances.
(iii) All allowances to meet the cost of uniform/rations.
(iv) Compensatory Allowances for the higher cost of living in expensive localities/hill stations.
(v) All house rent allowances.
(vi) Dearness allowance or other allowances to provide relief from increased cost of living
(vii) Children Education Allowance described in any manner.
(viii)All reimbursements of medical expenses.
(ix) Dearness pay if any.
The above allowances are exempted from court attachment.
(Rule 74 of CGA (R&P) Rules 1983)
23. What is the maximum amount of salary that can be attached?
(i) In case of decree for maintenance: (Gross emoluments – allowances exempted) X 2/3
(ii) In case of other decrees: (Gross emoluments – allowances exempted – Rs.1000/-) X 1/3

24. What is the restriction under FR 35 for officiating pay when a Government is ordered to work in higher posts?
As per DOPT OM No. 1/4/2017-Estt (Pay -I) dated 28.2.2019 under FR 35, the employees officiating in higher Level pay post, the officiating pay increase shall be restricted to that of, 12.5% of the basic pay subject to a maximum of Rs. 6700/- PM…Any increase in excess of 12.5% of the basic pay with a further ceiling of Rs. 6,700 per month shall be treated as substantial increase for the purposes of FR 35.
25. What are all the periods which will count for increment?
(i) All periods of duty.
(ii) Service in another post, other than a post carrying less pay.
(iii) All kinds of leave, other than EOL.
(iv) EOL granted: -
(a) On Medical certificate
(b) Due to inability to join duty on account of civil commotion.
(c) For prosecuting higher technical and scientific studies.
(v) Deputation out of India.
(vi) Foreign service.
(vii) Joining time.
(viii) Period of training before appointment on stipend or otherwise.
