40. Compulsory retirement pension:-
(1)
A Government servant compulsorily retired from service as a penalty may
be granted, by the authority competent to impose such penalty, pension
or retirement gratuity or both at a rate not less than two-thirds and
not more than full superannuation pension or gratuity or both admissible
to him on the date of his compulsory retirement.
(2)
Whenever in the case of a Government servant the President passes an
order (whether original, appellate or in exercise of power of review)
awarding a pension less than the full superannuation pension admissible
under these rules, the Union Public Service Commission shall be
consulted before such order is passed.
Explanation.- For the purpose of this sub-rule, the expression "pension" includes retirement gratuity...

40. கட்டாய ஓய்வின் போது வழங்கப்படும் ஓய்வூதியம்:-
(1)
ஒழுங்கு நடவடிக்கையின் முடிவில் தண்டனையாக கட்டாய ஓய்வு விதிக்கப்படும்
போது ஓய்வூதியமாக அல்லது பணிக்கொடையாக அல்லது இரண்டும் சேர்ந்து குறைந்த
பட்சமாக முழு ஓய்வூதியத்தில் 2/3 பங்கு வழங்கிட வேண்டும்.
(2)
ஒரு அரசு ஊழியரின் வழக்கில் ஜனாதிபதியே ஆணையிடும் பட்சத்தில் அந்த ஆணையினை
இடுவதற்கு முன் மத்திய தேர்வாணையத்தை கலந்து ஆலோசிக்க வேண்டும்.
இந்த விதியின் கீழ் ஓய்வூதியம் என்பதில் பணிக்கொடையும் சேரும்...
