Notes on enhanced Family Pension are given below which will be useful for your examinations

Previous ruling on enhanced Family Pension:

Rule No. 54 (3) (a) (i) of CCS (Pension) Rules, 1972: Swamy’s Pension Compilation – 2018 Edition:

Where a Government servant, who is not governed by the Workman’s Compensation Act, 1923, dies while in service after having rendered not less than seven years of of continuous service, the rates of family pension payable to the family shall be equal to 50 percent of the pay last drawn and the amount so admissible shall be payable from the date following the date of death of the Government servant for a period of ten years.

Current ruling on enhanced Family Pension vide G.I. Department of Pension & Pensioners’ Welfare Notification No. 1/23/ 2018-P - & P.W (E) dated19.09.2019 published in GSR 673 (E) in the Gazette of India dated 20.09.2019  :

Rule No. 54 (3-A) of CCS (Pension) Rules, 1972: Swamy’s Pension Compilation – 2020 Edition

Where a Government servant, who died within ten years before 01.10.2019, without completing continuous service of seven years, his family shall be eligible for family pension at enhanced rates in accordance with sub-rule (3) with effect from 01.10.2019 subject to fulfillment of other conditions for grant fo family pension.

 

 

Points learnt from the latest rulings are:-

1.  Enhanced family pension for the period of ten years which shall be equal to 50 percent of the pay last drawn is eligible for the family who died in service after 01.10.2019. There is no compulsory condition of rendering seven years of service.

 2. When a Government servant who died within ten years before 01.10.2019, enhanced family pension for the period of ten years which shall be equal to 50 percent of the pay last drawn is eligible for the family. There is no compulsory condition of rendering seven years of service.

 3. When a Government servant who died before 01.10.2019 and not within ten years of service, enhanced family pension for the period of ten years which shall be equal to 50 percent of the pay last drawn is eligible for the family, if the Government servant rendered seven years of service.

4. The family of a Government servant is not eligible for enhanced family pension for the period of ten years which shall be equal to 50 percent of the pay last drawn, when the Government servant dies while in service;                                                              (i) before 01.10.2019   

(ii) Not within ten years

(iii) Not after rendering seven years of service.

(and all the above three conditions are satisfied simultaneously)
